TERMS AND CONDITIONS OF THE STAMOU LOYALTY PROGRAM


The STAMOU WIN loyalty program has been created by the company STAMOU SMSA (hereinafter referred to as ‘STAMOU’ for the sake of brevity) with registered office in Acharnes, 206, L. Karamanlis Street, is intended for adult customers of STAMOU dairy stores and involves the recording and breakdown of purchases made, as members of the program, for themselves and their family members. The purpose of STAMOU customer loyalty program is, on the one hand, to reward customers for choosing to buy STAMOU products for themselves and their family members and to provide them with advance information about our products and services and, on the other hand, to record, analyse and research the purchasing habits of STAMOU customers (product categories selected, traffic, type of products selected by customers, response to general and special offers, etc.) in order to improve management of the company's customer base.

1. ISSUANCE OF ELECTRONIC MEMBERSHIP CARDS - CARD USE

- Any person over the age of 18 is eligible to sign up for the program.

- By accepting these terms and conditions, the member consents to receiving informational and/or promotional messages from STAMOU.

- Upon subscription to the program, an electronic membership card will automatically be issued.

- The electronic card is strictly personal. Transfer of the card or points earned is strictly prohibited.

- The electronic card can be applied for by completion and submission of a form containing the holder’s personal details to any STAMOU dairy stores or through the website www.stamou.gr

- The member is entitled to use the card for purchases at STAMOU dairy stores always in accordance with these terms and conditions which may be modified by STAMOU at any time by posting on the website www.stamou.gr. The membership card is not a credit or debit card. The member may only enjoy privileges as specified and posted on www.stamou.gr. In order to earn or redeem points, the member must be a member of the loyalty program and be identified as a member at the checkout counter of the retail store.

- Members are entitled to 1 point for every €1 of purchases made through transactions at our dairy stores, which can be redeemed using coupons against purchases at STAMOU dairy stores in accordance with the current loyalty program and the current methods determined for points redemption in each transaction. In addition, the member can earn double points (x2) for purchases from the following categories: Yoghurt, Cheese, Desserts - and triple points (x3) for purchases from the following categories: Ice cream, Sweets, Butter . If the member returns a product from a transaction involving the redemption of points, the points deducted from the redemption cannot be credited to the member's card upon return of the product.

- For every 120 points redeemed, the member receives an e-voucher worth €3 and for every 200 points redeemed, the member receives an e-voucher worth €5.

- The voucher is not exchangeable for cash.

- During the subscription process at the STAMOU dairy stores or via www.stamou.gr, the member's mobile phone is confirmed, the subscription of which must be registered by a Greek mobile telephony provider. The member registers in the scheme, and can then collect points.

- By way of exception and if the member does not have a mobile phone and therefore a mobile phone number, the member can register for the scheme by filling in an application form at the STAMOU dairy stores. Subscriptions are considered valid if the member has filled in the mandatory fields (first name and last name) and has signed the application form.

- Subscriptions using mobile phone numbers already in the database cannot be completed.

- The e-card, the number of points and the right to use vouchers may not be exchanged or redeemed for cash. Depending on the number of points the member has accumulated, they shall only be able to redeem these points and receive a corresponding discount. STAMOU reserves the right to unilaterally modify the reward system and to change or replace the value of the reward amount for purchases by informing members through a post on www.stamou.gr

- The member declares that all information contained in their application is true and accurate and that they are responsible for its accuracy. STAMOU is not responsible for granting membership privileges if the member has provided incorrect or inaccurate personal data.

- STAMOU may, at its sole discretion, terminate the STAMOU loyalty program, refuse to issue electronic loyalty program cards and cancel electronic loyalty program cards.

2. AMENDMENT - EXPIRY - TERMINATION

- STAMOU has the right to terminate this contract with the member or to prohibit any use of the card at any time, without notice or justification. In any instance if the member does not comply with these terms or in the event of misuse or attempted fraud through the membership card, all points shall be deleted, and all privileges shall be revoked.

- The membership card provides its holder with benefits for as long as the member holding it is recognized as a valid member of the STAMOU loyalty program and for as long as the STAMOU loyalty program is in effect. STAMOU reserves the right, at its absolute discretion, to change this time period and to unilaterally modify any term of this contract, including the reward system, the way points are calculated and the value of purchase rewards, as well as to modify or terminate the STAMOU loyalty program in general at any time.

- STAMOU has the right to activate or deactivate the card and/or to discontinue the loyalty program at any time, without notice or justification, as this program is offered by the company on a voluntary basis.

- STAMOU is entitled to unilaterally modify any term of this contract, including the method of calculating points and the value of rewards for purchases. Any such modification shall be posted on www.stamou.gr and shall be deemed to be valid and sufficient notice. The member has no claim against STAMOU for these changes or for the termination of the STAMOU program, since the member already acknowledges that this is a program of privileges provided freely by STAMOU.

- If for any reason STAMOU modifies part or all of the terms of the program or terminates the loyalty program, participants shall have no claim against the company, given that they herewith acknowledge that this is a loyalty program provided freely by the company.

- Points earned by the member are valid for 12 months from the date of the respective transaction under which they were earned or the date of the promotion from which they were earned, (for example, points earned on 15 June of one year shall expire on 15 June of the following year). Members get information about the total number of available points that they have earned through their purchases and/or regarding promotions, in the following ways: a) through their profile account at www.stamou.gr and b) at STAMOU dairy stores.

- Points and coupons can be redeemed at all STAMOU dairy stores.

- STAMOU also reserves the right to remove a member from the program and to terminate the validity of his/her card in the STAMOU Loyalty Program in any case where the member objects to or restricts the processing of his/her personal or non-personal data (with the exception of managing commercial communication and direct advertising in their contact details) or requests the deletion of the personal data that they have communicated or generated through transactions with their STAMOU loyalty program card, because in these cases it is not possible for the loyalty program to operate or for STAMOU's contractual obligations to be fulfilled.

- If a member requests to unsubscribe from the STAMOU loyalty program, STAMOU shall retain the member's personal data for thirty (30) days from the day of unsubscription. However, the member is informed that even after these 30 days, STAMOU shall retain the tax data relating to their purchases, while some basic data relating to the member shall also be retained, and shall remain in its files to ensure the legality of its processing (e.g. their mobile phone number and e-mail address in encrypted form, the date of subscription and unsubscription from the loyalty program) in order to safeguard the legitimate interests of STAMOU.

If, after unsubscribing, the member wishes to rejoin the STAMOU loyalty program, they re-subscribe to the program because the cancelled card cannot be reactivated.

3. PERSONAL DATA POLICY

3.1. Legal Basis and Transparency of Processing Data Updating:

STAMOU informs the member of the following, and the member of the program acknowledges that they are aware of the following:

3.1.a. When processing the personal data of members of the STAMOU loyalty program as described below, STAMOU relies on the following legal basis:

- Contract execution: In order to fulfil the purposes of this contract and the STAMOU card, namely, a) participation of the member in the program with recording and breakdown of their purchases and rewarding of the member with points and benefits resulting from their purchases, b) informing the member about special offers and premium services and c) overall analysis of the general purchasing tendencies of the program’s members, it is necessary to process personal data provided by the member during subscription to the STAMOU program, as well as data arising from their transactions.

- Legitimate interests: STAMOU reserves the right to process the member’s personal data in order to improve management of its customer base and promote its products.

Data Subject’s Consent: By subscribing to the program, members have consented to the processing by STAMOU of personal data that they have communicated during their subscription and the data resulting from their transactional relationship with STAMOU, for the purposes mentioned in the terms of use of the program.

STAMOU also reserves the right to regularly inform the member via telephone communication, e-mail, mobile phone message (SMS/Viber) or any other appropriate chosen means of communication when entering in their contact details, legally acquired in the context of subscription to the STAMOU loyalty program, to receive information about our products and services in the context of their commercial relationship (Article 11 (3) of Law 3471/2006), provided that the member has not objected to such communication. When subscribing to the STAMOU loyalty program, members agree to receive communications via e-mail, SMS or Viber messages. This information may include privileged and special information about our products, special and/or general offers, promotions and contests. In addition, STAMOU may communicate with the member through messaging services such as SMS, Viber, etc. for improved communication with members and for the purposes of controlling the cost of communication. Members are free to choose the communication channels that STAMOU will use to keep them informed or to request the termination of all commercial communication through their personal account at www.stamou.gr. Any member who has objected to commercial communication from STAMOU will not be able to receive informative and promotional messages. It is hereby specified that STAMOU shall continue to use the communication channels for non-commercial communication with the member regarding the use of their card and the present terms and conditions.

3.1.b. The member has the right and the obligation to access, correct and update their personal data and must immediately notify the company of any change to it. Any potential change, especially in the mobile phone number, which the member has declared during their subscription to the STAMOU program or thereafter, shall be made exclusively through their personal profile account at www.stamou.gr.

3.2. Type and recipients of personal data - Members' rights

3.2.a. Type of Personal Data:

STAMOU collects and processes the aforementioned personal data as well as the data generated by use of the card by the member:

i. for performing the terms of the STAMOU loyalty program

ii. for communicating general or special offers to the member and informing the member about STAMOU products and services

iii. for providing the benefits of the card and the analysis and research of the purchasing tendencies of the company’s customers (product categories selected, use, type of products selected by customers, response to general and special offers, etc.) in order to improve the management of the company’s customer base and to provide the products and services that best suit the company’s customer base,

iv. to fulfil the company’s obligations under the law, such as when the relevant data is requested by the tax authorities in the context of audits or to serve the company’s obligations and legal interests, such as in cases before regulatory, administrative or judicial authorities and to ensure that the member is an adult natural person and a resident of Greece.

3.2.b. Recipients of data

For data necessary to serve each of the above processing purposes and within the scope of the responsibilities of each recipient, the recipients of a member's data may be:

i. The competent officials of STAMOU

ii. The tax, audit, judicial, regulatory, etc. authorities in the event of an audit

iii. The company under the name "MENA FRANCHISE SERVICES", which provides CRM services and which has undertaken, inter alia, the subscription, updating and maintenance of the database with the data of members as the processor on behalf of STAMOU and in accordance with its instructions and recorded mandates and/or any other company providing in the future the same services to STAMOU in lieu of or in cooperation with the above company.

iv. External partners who provide call center and data analysis services, to whom data necessary for the fulfilment of their tasks and for the service of members are transmitted subject to strict restrictions and procedures.

During the subscription and processing of the member's personal data, the employees and contractors of STAMOU as well as all those who perform the processing on STAMOU’s behalf, comply fully with the provisions of the European General Regulation 2016/679 as well as with the applicable Greek legislation and case law on the protection of personal data and are contractually bound to comply with their obligations.

3.2.c. Data subject rights:

Each member, as a data subject, may at any time exercise their rights, as provided for in General Data Protection Regulation 679/2016 EU (in particular Articles 12 to 23 thereof) and national legislation, in particular:

i. the right to information and access to their personal data processed by STAMOU in the context of the STAMOU benefits card,

ii. the right to restrict the processing of their data related to the STAMOU benefits card,

iii. the right to rectification or erasure (right to be forgotten) of some or all of their personal data related to the STAMOU benefits card,

iv. the right to object, i.e. to object to the processing of their personal data related to the STAMOU benefits card; and

v. the right to the portability of their data associated with the STAMOU benefits card.

The member may exercise the above rights as follows:

For the right/obligation to access and correct/complete personal data , the Company provides the opportunity for the members of the STAMOU program to view, correct/complete their personal data:

- by logging in to their profile on the STAMOU website www.stamou.gr

For the right to obtain a copy or portability of personal data , STAMOU provides the possibility for members of the STAMOU program to obtain their personal data and/or to transmit them to another controller in the format indicated by the competent supervisory authority, by written letter to STAMOU at 128-130 Kifissou Ave. (Attention: DPO)

For the right to restriction of processing, the right to erasure of part or all of the data (right to be forgotten) as well as the right to object to the processing of personal data related to the STAMOU benefits card, the member may submit a request at the brick and mortar STAMOU stores.

In case of exercise of any of the above mentioned member's rights, STAMOU shall take all possible measures to satisfy the request within (1) one month from the date of its valid submission and if more time is required, it shall inform the member accordingly. In this case, the member is informed that it is possible that some minimally necessary data pertaining to him or her may be retained to safeguard the legitimate interests of STAMOU. It is hereby specified that in order for the exercise of the above rights to be considered valid, identification of the member may be required in order to ensure that the personal data for which any of the above actions is requested actually belongs to the member/individual requesting the specific action.

Membership withdrawal from the STAMOU program can be done by the member submitting a request to a brick and mortar STAMOU store.

Each member can also request at any time that commercial communication be stopped, to one or all of their contact details (email, SMS on their mobile phone or Viber on their mobile phone) through their personal account at www.stamou.gr

The member should also be aware that, due to the nature of the functioning of the STAMOU loyalty program, any exercise of any of the above rights and in particular the right to oppose or restrict the processing and, partial or total, deletion of the member's data, may result in difficulties in the smooth operation of the loyalty program, therefore STAMOU reserves the right to cancel the points collected by the member within thirty (30) days from submission of the relevant request and to temporarily deactivate the card.

3.2.d. Personal Data Retention Period:

The member's personal data shall be retained and processed by STAMOU until the member cancels the STAMOU card. However, certain essential personal data pertaining to the member's transactional relations with STAMOU, as well as the member's declarations regarding the processing of their data may remain as information about the member in STAMOU's systems to evidence the legitimacy of data processing by STAMOU and to safeguard the legal claims of the parties.

3.2.e. Special Category Data:

The member is informed that STAMOU does not collect, or require disclosure by the member of, sensitive personal data (special category data) for the purposes of the STAMOU membership card.

3.2.f. Duty of Transparency:

For any information regarding their personal data as well as its processing and protection, the member may contact the STAMOU Data Protection Officer (DPO) at jotis@jotis.gr and if they are not satisfied with the actions of STAMOU, they is informed that they have the right to appeal to the competent supervisory authority (Personal Data Protection Authority, 1-3 Kifissias Ave., P.O. 115 23, Athens).

3.2.g. Technical and Organizational protection measures:

STAMOU, persons conducting processing on its behalf, its agents and assistants engaged there in shall implement appropriate technical and organizational measures to protect personal data as far as possible against accidental or unlawful destruction or loss, alteration, unlawful disclosure or access and unlawful processing in general (including by remote access) and to ensure the possibility of restoring the availability and accessibility of personal data.

These measures aim to ensure a level of security appropriate to the risk to which specific data may be exposed, always taking into account the nature and sensitivity of the data, the technical capabilities of STAMOU and its partners, the developments in technology, the cost of implementation and the nature, scope, context and purposes of each specific processing operation, at the same time implementing procedures for the regular testing, assessment and evaluation of the effectiveness of such techniques and organizational measures.

In any case, STAMOU, its processors and its employees/assistants are contractually bound to maintain the confidentiality of members' personal data and not to disclose it or allow access to it by any third party without the prior notification of the member, except in cases expressly provided for by law.

4. CONDITIONS FOR REDEMPTION OF STAMOU PROGRAM POINTS

- Members are entitled to redeem their points if they are active members and the current balance of credited and available points on their electronic card is at least equivalent to the number of points (‘STAMOU points’) corresponding to discount coupons valued at €3 & €5. To this end, the member will be able to calculate the total number of points credited and available to him or her. The member is not entitled to substitute part or all of the points collected with cash, nor to redeem these points for cash. Vouchers expire 3 months after issue.

- If the member returns all or part of the products they purchased from which they earned points, then the points corresponding to the value of the return shall be deducted from the member's account, given that a refund is made. If the member returns a product resulting from a transaction involving the redemption of points, the points deducted from the redemption cannot be credited to the member's card.

- Each time the member redeems points corresponding to a discount coupon, the same number of points is deducted from the balance of points available. Purchases using the redemption discount are not eligible for a refund. The discount is not exchangeable for cash. In order to qualify for the corresponding discount, the member must make purchases of equal or greater value. It is hereby specified that STAMOU reserves the right to change the point calculation system at any time, or to change the points that the member is required to accumulate.

5. OTHER TERMS

STAMOU does not bear any liability for any damage, primary or secondary, positive or consequential, direct or indirect, to the member from the use and implementation of the STAMOU loyalty program. In any case, any liability on the part of STAMOU shall be limited solely to the re-crediting of any lost points to the member's loyalty card. STAMOU is not liable for any damage to the member, the other members of the program or third parties, due to false or inaccurate statements made by the member, especially with regard to the member's personal data.

The present terms constitute the sole and full contractual text governing the relationship between STAMOU and the members of the STAMOU loyalty program and supersede any previous form of these and shall remain in force until any subsequent modification by STAMOU, which shall be effective either from their notification to the members, or from the date of the company’s posting on www.stamou.gr.

The present terms apply to the members of the STAMOU program in Greece and govern their relationship with STAMOU as of 31 January 2023. Any interpretation thereof or resolution of any dispute between members and the STAMOU company shall be determined in accordance with Greek law, while the Courts of Athens shall be exclusively competent to determine interpretation thereof.
